1. About the service
uberisam.com (“UBeriSam”, “we”) is run by Panonium consulting d.o.o., OIB (Croatian personal identification no.) 97010885457, Međašni klanac 1, 10000 Zagreb, Croatia, contact [email protected].
UBeriSam is a free listings site that connects fruit and vegetable growers (family farms and other producers) with people who want to pick their own produce or work at the harvest. We don't sell products, don't organise the picking, are not an employer or employment agency and are not a party to any arrangement, sale or work agreement between a grower and a visitor or picker. Payment and everything else is agreed directly between them.
By using the site you accept these terms. How we handle personal data is explained in the Privacy Policy.
2. Rules for growers
- You need an account to publish listings. You sign in by email or with Google/Facebook and you are responsible for everything published from your account.
- You may only publish u-pick events you actually run, on land where you're allowed to, with accurate, up-to-date details: products, location, dates, opening hours, prices and contact.
- You are responsible for your listing and the u-pick, including:
- prices, weighing, payment and receipts, and all tax, registration and other legal obligations,
- the safety and quality of the produce, including observing pre-harvest intervals after plant protection treatments,
- safety on your farm: the condition of the ground and paths, machinery, ladders, animals, sanitary facilities and parking, and clear instructions to visitors about rules and hazards,
- keeping to the maximum number of visitors you set, and announcing changes, postponements and cancellations on the site in good time.
- You may use the sign-ups you see in “My picking events” (name, phone, email) only to organise that event, not for marketing or passing on to others. You are responsible for that use under data protection law.
- You must not publish content that is false, misleading, unlawful or offensive, that infringes others' rights, or listings that are not u-picks or picking jobs (e.g. resale or spam).
- Picking-job listings: state the real pay, working hours and conditions. You are the employer or client and are responsible for engaging pickers lawfully (e.g. contract, registration of seasonal work, safety at work, payment). You may use pickers' data (name, mobile number, email) only to arrange that job.
- OPG/business verification: you may submit your OIB, legal name and optional proof for a “Verified” badge. Details must be accurate. Misrepresentation or forged documents are not allowed. A moderator may reject or remove the badge. OIB is never public.
- Field status, deals, time slots and amenities: you are responsible for keeping them accurate and up to date. A deal price must really be lower than the regular price and valid until the date shown; change the field status (“ripe”, “ending soon”, “sold out”, “closed today”) as soon as it changes; and keep to the number of places per slot just like the maximum number of visitors. The note with the field status is published immediately, without prior review, and must follow the same rules as the listing.
- Picker ratings: you may only rate a picker who attached a profile after a real work day, fairly and only about the work (punctuality, reliability, quality of picking). Not allowed: insults, discrimination (e.g. based on origin, sex, age or health), personal data, ratings in exchange for something or as retaliation. The picker can dispute a rating, and a moderator can hide a rating that breaks these rules. You may use picker profiles and ratings only to decide about that job.
- By publishing, you give us a non-exclusive, free right to show the listing's content on the site and in the alerts we send to users, for as long as the listing is published.
3. Rules for visitors and pickers
- You visit a u-pick at your own risk. Follow the grower's instructions, watch out for the terrain, tools and animals, and supervise children.
- Respect the farm and crops: only pick what and where you're allowed to.
- You agree the price, payment and quantities directly with the grower. Check the details and opening hours with the grower before you go, especially in bad weather.
- Wash produce before eating it. If you have allergies or special health needs, check the conditions on the farm with the grower.
- Only send a picking-job application for yourself, with your correct mobile number. UBeriSam is not the employer or an employment agency: you agree working terms, pay and payment directly with the grower.
- Only send an “I'm coming” sign-up for yourself and the people coming with you, with correct contact details. If you can't come, let the grower know.
- Fill in your picker profile truthfully. A grower you apply to with your profile attached can rate you after the work; you can dispute an unfair rating in “My picker profile”.
4. Shared rides
- “Rides” is a noticeboard where users arrange going to a u-pick or a picking job together among themselves. UBeriSam does not organise, check or guarantee rides, drivers or passengers and is not a party to their arrangement.
- Rides are shared free of charge or by sharing fuel and toll costs. Transport for profit (taxi, passenger transport as a business) is not allowed.
- The driver is responsible for a roadworthy, insured vehicle, a driving licence and following traffic rules. Passengers travel at their own risk.
- Only post a real ride with correct details, and tell the other side if your plans change. Use contact details you get through a ride only to arrange that ride.
- You can report an inappropriate or suspicious ride, and a moderator can hide it.
5. Farm reviews and comments
- Only real u-pick visitors and pickers can rate a farm: after the visit or work day they get an email with a one-time link, and each visit sign-up or job application can be reviewed only once. A review applies to the whole farm (all its u-picks and picking jobs).
- Write fairly and about your own, real experience. Not allowed: insults, threats, hate speech and vulgarity; other people's personal data (names, numbers, addresses); ads and links; fake reviews, reviewing your own farm, or reviews in exchange for a reward or discount; content unrelated to the visit or work.
- A review is published immediately with your first name and last initial and the type and month of the visit. You are responsible for the content of your review.
- The grower can post one public reply to each review in “My picking events” and later edit or remove it. Replies must follow the same rules — no insults and no disclosure of the visitor's or picker's details.
- Reviews are not checked automatically. Anyone can report a review with the “Report” link, and a moderator can hide or delete a review or reply that breaks these rules. A hidden review doesn't count towards the average. We don't remove reviews just because they are negative.
- Growers must not solicit, reward or prevent reviews, or use them against visitors or pickers.
6. Moderation
- We review new listings before they are published. We may approve, reject or later remove a listing, especially if it is inaccurate, incomplete or breaks these terms. We usually tell you the reason for a rejection by email.
- Our review does not guarantee that the details in a listing are correct or that a u-pick is safe or lawful. We only check what we reasonably can.
- For serious or repeated breaches we may suspend or close an account.
- We moderate reviews and replies under the rules in section 5, and picker ratings and rides under the rules in sections 2 and 4.
- If you notice a problematic listing or content, tell us at [email protected] and we'll look at it promptly.
7. Notifications and messages
We send the emails needed for the service (sign-in links, confirmations, listing approval notices, messages about event changes, one invitation to rate the farm after a visit or work, ride messages), and alerts about new u-picks and about farms you follow only to people who signed up for them and confirmed, by email or on their device (web push). You can unsubscribe from alerts with one click in every alert email, and switch off device notifications on the site or in your browser. The number of messages we can send may be limited, so an alert may occasionally arrive late.
8. Limitation of liability
- We provide the site free of charge, “as is”. We don't guarantee that it will always be available or error-free, or that every message will be delivered.
- Users themselves, not UBeriSam, are responsible for listing content (including field status and deal prices), the u-pick itself, produce, prices, damage or injuries on the farm, shared rides, and disputes between growers, visitors, pickers and fellow travellers.
- To the fullest extent permitted by law, we are not liable for indirect damage, lost profit, or damage caused by the site being unavailable or by inaccurate details entered by users.
- Nothing in these terms excludes or limits liability that cannot be excluded by law, in particular for damage caused intentionally or by gross negligence, or the rights consumers have under mandatory law.
9. Ending use and deleting your account
You can stop using the site at any time. You can ask for your account and data to be deleted by following the data deletion instructions. We may change or discontinue the service, and will tell registered users in good time.
10. Changes and governing law
We may change these terms. The current version is always on this page, and we'll tell registered users about significant changes by email before they take effect. If you keep using the site after that, you accept the changed terms.
Croatian law applies. Disputes fall under the competent court in Zagreb, unless mandatory consumer protection rules provide otherwise. Before starting any proceedings, please contact us at [email protected] so we can try to solve the problem amicably.
